Confirming an order form with a “double click” constitutes an electronic signature and represents irrevocable acceptance of the T&Cs. Consequently, the Customer acknowledges that they may only order Products or Services on the site if they fully accept the provisions below.

Preamble

These T&Cs govern all transactions carried out on INDUSTRICOM’s online catalog. Any order placed on the site implies the Customer’s unconditional and irrevocable acceptance of these T&Cs, which prevail over any other document.

Purpose

This contract is a distance-selling contract defining the rights and obligations of the parties within the framework of the online sale of the Products offered by INDUSTRICOM on the platform www.industries.ma, a brand and service belonging to INDUSTRICOM.

Definitions

For the purposes of these T&Cs, the following terms have the meanings indicated below:

• Distance Contract: any contract concluded between INDUSTRICOM and a Consumer through an organized remote sales system exclusively using the Internet up to the conclusion of the contract.

• Consumer: any individual acting for purposes not related to their professional activity.

• Order Form: electronic document summarizing the Products selected by the Consumer, to be validated via a “double click” to become binding.

• Order: a firm commitment by the Consumer to purchase the selected Products and pay their price; and a corresponding commitment by INDUSTRICOM to deliver said Products.

Products

The Products presented in the online catalog are offered within the limits of available stocks. INDUSTRICOM reserves the right to withdraw any Product from the catalog without notice or compensation.

INDUSTRICOM cannot be held responsible in the event of incompatibility between the Product ordered and the equipment already owned by the Customer.

Order Process

After selecting the desired Products, the Customer clicks on “Order” to add them to the Order Form. They may modify it at any time or continue shopping.

Once the selection is complete, the Customer confirms their Order by clicking on “Pay”.

If an input error occurs, the Customer is invited to request cancellation by email within a maximum of 24 hours. After confirmation of cancellation by INDUSTRICOM, a new Order may be placed.

Prices

Prices are displayed in Moroccan dirhams (MAD), all taxes included. They are valid when the site is consulted and applicable on the date of the Order.
VAT is calculated at the rate in force on the date of the Order.
Any change in VAT rate will automatically be reflected in the Product price.
Transactions may be carried out in dirhams or in foreign currencies.

Execution of the Order

The Order is processed within a maximum of seven (7) days from the day after its validation.

In the event of product unavailability, the Customer will be informed as soon as possible and may:

• Cancel the Order and be refunded within a maximum of thirty (30) days; or

• Accept a replacement Product or an exchange.

Payment Methods

The Customer chooses the payment method from the options available on the dedicated page. The account is debited the day after delivery confirmation.

Multi-channel payments are secured by the Interbank Electronic Payment Center (CMI).

The Customer guarantees that they have the required authorization to use the selected payment method. In case of payment by bank card, the rules concerning fraudulent use of the payment method, as defined in the contracts between the Customer, the card issuer, and INDUSTRICOM’s banking institution, apply.

Data Confidentiality

Personal information provided by the Customer is necessary for processing the Order and is handled confidentially.
The Customer has the right to access and rectify their data in accordance with applicable regulations.

Unless the Customer explicitly objects, they may receive commercial communications from INDUSTRICOM.

Cancellation of an Order Paid by Bank Card

Any request to cancel an Order paid by bank card must be made in writing (email or letter) as soon as possible. After verification and approval of the request, INDUSTRICOM will refund the amount using the same payment method used during the Order.

The refund time may vary depending on banking channels, without INDUSTRICOM being held responsible.

ADDITIONAL WARNING

INDUSTRICOM reminds users that access to and use of the website www.industries.ma is under their sole responsibility. The information on the site is provided for guidance only and may be modified at any time without notice. INDUSTRICOM cannot guarantee the total absence of errors, interruptions, or technical issues affecting access to the site.

INDUSTRICOM shall not be held liable for:

• Service interruptions, regardless of their duration or origin;

• Any damage resulting from improper use of the site by the user;

• Any indirect damage related to the use of the site or temporary inability to access it.
